The conseil constitutionnel failed hard on that point.

For my non francophone followers, let’s be clear : the law was suppressed because it wasn’t precise enough with its definition of ‘harassment’. Because of the modifications made in 2002, the law only talked of the goal of such harassment (sex) but didn’t mention its forms (like threats…). Meaning the Parliament needs either to get back the version of 1998 of the law, either vote a new one.

That was for the don’t panic part. Unfortunately, since the conseil constitutionnel (the council checking if French laws are legal) declared the law unconstitutionnal, it had been removed from the Constitution and the Penal Code. Meaning they created a loophole, a plothole, whatever you want : sexual harrassment isn’t penally condemned in France - though it seems it is mentionned in the Work Code, but I’m not law student, so I don’t know if it offers enough protection - and the sexual harrassment pending cases are dropped for the time being.

It doesn’t help we’re in the middle of the elections period, presidential elections next week-end, and even better, legislative ones in June. Which means a bigger delay before the problem arrives into the hand of the Parliament.
